The governor’s office wrote in a letter to Geragos that Newsom’s “primary consideration when evaluating commutation applications is public safety, which includes the applicant’s current risk level, the impact of a commutation on victims and survivors, the applicant’s self-development and conduct since the offense, and if the applicant has made use of available rehabilitative programs, addressed treatment needs, and mitigated risk factors for reoffending.”

Newsom weighs a number of factors when reviewing clemency applications, “including an applicant’s self-development and conduct since the offense, whether the grant is in the interest of justice, and the impact of a grant on the community, including crime victims and survivors,” according to his office.

Newsom’s office said “a pardon grant recognizes the grantee’s self-development and accountability after conviction,” but does not erase a conviction or seek to minimize the harm caused by the recipient.

The governor’s office considers the effect of a commutation or pardon on the community, the age and circumstances of the crime and sentence, self-development and rehabilitation, and the need for clemency, among other factors.
